1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and KeeMak AI ("we," "us," or "our"), concerning your access to and use of the KeeMak AI mobile application (the "App").

By accessing or using the App, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. The App and AI-Generated Results

KeeMak AI helps users identify insects and bugs from user-uploaded photos. When you submit a photo for analysis, the App may send that photo and related context to a third-party artificial intelligence provider so an identification result can be generated.

The App's results are AI-generated estimates. They may be incomplete, inaccurate, outdated, misleading, or wrong. The App does not guarantee that any insect, bug, bite, sting, nest, infestation, species, risk, or other condition will be identified correctly.

You are solely responsible for how you use the App and any results it provides. You must not rely solely on the App for safety decisions, treatment, pest control, handling, consuming, purchasing, or any other consequential action. If a situation may involve injury, illness, allergy, poisoning, venom, a dangerous animal, property damage, pest infestation, or any emergency, contact an appropriate qualified professional or emergency service.

3. Intellectual Property Rights

3.1 Our Intellectual Property

Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, reference content, and other materials in or made available through the App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.

KeeMak AI does not permit use of App Content except as expressly allowed by these Terms, the App, or written permission from us. Reference or educational content used by KeeMak AI should be owned by us, licensed to us, in the public domain, available under a Creative Commons license with required attribution, or used with permission. We do not rely on copyright fair use as an operating assumption for App Content.

3.2 User Contributions and License

By uploading, posting, or submitting any content, including photos, analysis inputs, notes, feedback, labels, or related context (collectively, "User Contributions") to the App:

  1. Ownership: You retain ownership of your User Contributions.
  2. Limited License to KeeMak AI: You grant KeeMak AI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and use your User Contributions only as reasonably necessary to provide, maintain, secure, support, improve, and operate the App; generate and display insect identification results; provide user-requested account features; troubleshoot issues; enforce these Terms; comply with legal obligations; and protect the safety, security, and integrity of the App.
  3. Third-Party AI Processing: You authorize KeeMak AI to send User Contributions and related context to third-party AI providers where reasonably necessary to provide App features.
  4. License to You: KeeMak AI grants you a limited, non-exclusive, revocable license to view and access your User Contributions and App-generated results through the App solely for your personal, non-commercial use as part of the App.
